Freestyle Brands, LLC ("Freestyle USA," "Freestyle," "we," "us" or "our") has created this privacy policy (this "Privacy Statement" or "Privacy Policy") for our website, mobile applications, products, services, and related digital experiences (collectively, the "Site") in order to demonstrate our firm commitment to privacy.

1. Age Requirements

Participation and registration on this Site is restricted to those individuals at least 18 years of age or those who possess legal parental or guardian consent and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties herein. Consistent with the Children's Online Privacy Protection Act, we will never knowingly request personally identifiable information from anyone under the age of 13 without obtaining parental consent. Moreover, we request that no information be submitted to this Site by Visitors under the age of 13. Children between 13 and 17 must obtain their parent or guardian's consent to submit or post any information on this Site.

By registering or participating in services or functions on this Site, you hereby represent that you are (a) at least 18 years of age, or (b) are between 13 and 17 years of age and in possession of consent by a legal parent or guardian who has entered into the terms herein on your behalf.

2. Personal Information Collected

A. Personally Identifiable Information

We collect personally identifiable information from Visitors.

Visitors may provide Visitor Content (as defined in our Terms of Service) or personally identifiable information through optional, voluntary submissions, such as by contacting our customer service department via e-mail, entering submissions to receive our e-newsletters, registering on our Site, placing orders, registering products, requesting repairs, participating in our polls, surveys and sweepstakes, or using related services.

D. Registering for an Account

If you create an account with us, or if an account is created in connection with a product registration or related service request, you may be asked to provide information such as your full name, e-mail address, telephone number, and other information necessary to provide products, services, customer support, warranty support, repairs, product registration, or related services.

E. Orders

If you purchase our products, you will be asked to provide billing, shipping, payment, and order information, including information such as your name, address, telephone number, email address, payment details, products purchased, order number, shipping details, and related transaction information.

Payment, checkout, billing, and collection functions may be handled by third-party payment processors, ecommerce platforms, digital wallet providers, and service providers. Your order and payment information may be shared with such providers as necessary to process payments, complete transactions, prevent fraud, fulfill orders, and provide related services. F. Product Registration

Freestyle offers optional product registration services through the Site. If a Visitor or Customer chooses to register a product, Freestyle may collect information voluntarily submitted by the individual, including purchase information, product information, photographs, proof of purchase, warranty-related information, and other information necessary to provide product registration, warranty support, repairs, customer service, or related services.

Product registration information may be associated with an existing customer account or used to create a customer account in order to provide product registration, warranty support, repairs, customer service, and related communications.

Product registration is generally optional; however, registration may be required to verify eligibility for certain warranty-related services or benefits.

Certain product registration, warranty, repair, or customer service features within the Freestyle mobile application may request access to the device camera or photo library when an individual chooses to upload photographs, proof of purchase, product images, or related materials. These permissions are optional and may be managed through the device settings.

G. Optional Location-Based Services

Certain optional features within the Freestyle mobile application may request access to location services, such as when an individual chooses to locate nearby retail locations. Location-based services are used only when requested by the individual and may be managed through the device settings.

H. Polling

We may offer interactive polls to Visitors so they can easily share their opinions with other Visitors and see what our Visitors think about important issues. Opinions or other responses to polls are aggregated and are not identifiable to any particular Visitor. We may use a system to "tag" Visitors after they have voted, so they can vote only once on a particular question.

I. Surveys

Sometimes we post optional surveys in which we ask Visitors for contact information (e.g., their e-mail address and phone numbers) and demographic information (e.g., their zip code, age, or income level). The choice is yours; you do not have to answer surveys. If we are asking for optional information, we will mark the required information with an asterisk (*) so you know the unmarked fields are optional and you can skip them if you want.

J. Contests and Sweepstakes

Once in a while, we run contests and sweepstakes on our Site in which we ask Visitors for contact information (e.g., their e-mail address and phone numbers) and demographic information (e.g. their zip code, age, or income level). Sometimes a Visitor may be asked to fill out a brief survey in exchange for allowing such Visitor to enter the contest or sweepstakes. Any sweepstakes and other contests will be subject to special rules which will be identified on this Site.

B. Sale or Acquisition of Assets

If we sell Freestyle, our subsidiaries or business units, Visitor information generally is one of the transferred business assets. Also, if we or substantially all of our assets are acquired, your information as a Visitor on this Site will be one of the transferred assets. If we purchase a business, the personally identifiable information received with that business would be treated in accordance with our Privacy Statement in effect at that time, so long as it is practicable and permissible to do so.

If we sell a business, we will include provisions in the selling contract requiring the purchaser to treat your personally identifiable information in the same manner required by our Privacy Statement in effect at that time. The provisions of this paragraph will apply also if we are sold as a part of bankruptcy proceedings.

C. Retention of Data

We may retain any data you submit to us or that we otherwise gather from your visits to our Site. Upon receipt of a verified request submitted through our Contact Us page or by e-mail to support@freestyleusa.com, we will review requests to access, correct, or delete personally identifiable information in accordance with applicable laws and business obligations. Certain information may be retained where necessary to complete transactions, maintain warranty or repair records, comply with legal obligations, prevent fraud, or protect the rights and interests of Freestyle and its Visitors.

4. Site Navigational Information

As stated above, we use Site Navigational Information to collect information as you navigate our Site. This Section describes the types of Site Navigational Information we may collect and how we may use this information.

We may use analytics tools and service providers, including Google Analytics, Firebase Analytics, Google Tag Manager, and similar technologies, to better understand how Visitors interact with the Site, improve functionality, analyze performance, and enhance the user experience.

A. IP Addresses

An IP address is a number that is automatically given to your computer or device when you use the internet. We use your IP address to help diagnose problems with our server, to administer our Site, and to provide aggregate data to advertisers about the volume of use on our Site. Your IP address is also used to gather broad demographic information. We do not link IP addresses to anything personally identifiable, which means that your session will be logged, but you will remain anonymous to us. We do not control the user-posted content on our social media homepages and are not responsible for any third-party use of your personal information that you have posted, transmitted or otherwise made available there.

We may also use third-party partners, vendors, agents, and service providers to operate the Site, process transactions, provide mobile application functionality, analyze usage, deliver marketing communications, measure advertising, fulfill orders, provide repairs, support product registration, and provide customer service. These providers may process information on our behalf as necessary to provide their services.

6. Mobile Alerts

By entering your mobile telephone number on our customer form on this Site or via sweepstake forms, then selecting "I hereby consent to receive text messages from or on behalf of Freestyle at this phone number. I understand that consent is not a condition of purchase" and then replying "Y" to confirm and e-sign, you are providing your consent and agreement that you are 18 years of age or older, or if you are 13 years of age or older, that you have parental consent to receive commercial text messages and alerts from us on your mobile phone. You agree to receive such texts once you have consented in the manner set forth above even if you are on a state and/or federal Do Not Call List.

You can expect to receive up to five (5) messages per month. Promotional text messaging shall include event alerts and updates, discounts, and special offers available to mobile alert participants. We respect your privacy and will never sell or share your cell phone number except in accordance with this Privacy Statement.

We will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an "AS IS" basis.

Message and data rates may apply. This service may not be available on all carriers.

You may cancel the program at any time by texting the keyword "STOP" to the short code provided in the applicable text message. We will send you a final text confirming your cancellation. You agree and give consent to receive this one (1) last text.

7. Security

This Site has security measures in place to protect the loss, misuse and alteration of the information under our control. Visitors may opt-out of participating in certain interactive areas (e.g., participation in online shopping or sweepstakes).

Although it is not always possible to remove or modify information (other than a registered account holder's information, as described in Section 8, above), we will make reasonable efforts to do so. 13. Fraud Protection

You matter!

We make every effort to ensure that your transaction is safe and secure. Unfortunately, from time to time we receive orders that are suspicious in nature. In an effort to verify these orders and protect against the unauthorized use of your credit card, we may contact you via e-mail and ask that you confirm details about your account. We realize that this may cause a delay for Priority Orders if such information cannot be verified within twenty-four (24) hours. However, this procedure is for your protection. If we do not hear back from you within five (5) business days of our e-mail request, your order will be cancelled. We reserve the right to cancel any order that we deem suspicious or fraudulent. We are committed to providing our Visitors with the highest level of customer service possible as well as a positive shopping experience.
